A Proposed New Landlord and Tenant Law for Ontario: Key Changes to Affect Non-Profit Housing Providers
Two years after releasing a discussion paper on policy directions for a new landlord and tenant law, the Province of Ontario finally tabled new legislation - the Residential Tenancies Act , 2006 - on May 3, 2006. This new law, once it is passed and proclaimed, will replace the current Tenant Protection Act.
Landlord-tenant laws in Ontario affect the day to day operations of all non-profit housing providers. ONPHA has been working with the Province to ensure the Ministry of Municipal Affairs and Housing is fully aware of non-profit housing providers' concerns. ONPHA initially submitted a summary of key non-profit housing provider issues to the provincial government in March of 2004 , even before a discussion paper was tabled.
Once the Provincial government released its Residential Tenancy Reform Consultation Paper , in late April, 2004 regarding possible changes to the laws affecting landlord and tenant issues, ONPHA asked for its members input. In the summer of 2004, based on that member input, ONPHA submitted a formal response to the discussion paper outlining the non-profit housing perspective on a new landlord and tenant law.
With the tabling of first reading legislation, the government has clearly agreed with some of ONPHA's positions, but the proposed law raises other concerns for non-profit housing providers. Read a comparison of issues between ONPHA's position and the new Residential Tenancies Act.
